 こうして箱館は、安政2年3月の開港によって一挙に欧米列強と直接関係を持つこととなったが、開港がクリミヤ戦争の時期と重なったために、箱館は開港と同時に、ヨーロッパにおける国際緊張の渦の中に巻き込まれることにもなった。それだけに開港直後には、これら入港船との間に様々な問題が発生し、現地の最高責任者である箱館奉行は、その対応に忙殺されることになった。そこでここでは、安政2〜3年におきた諸問題のうち、この期に特有な問題とみられるものを2〜3とりあげ、開港直後にこれら入港外国船ないしは来航外国人とのかかわりで箱館奉行が直面した対外問題の性格と、それに対する同奉行ないしは幕府の対応のあり方について若干検討を加えておきたいと思う。
 まず最初に、開港直後に箱館に来航したアメリカ商人と彼等の日米和親条約の条文を楯にした交易と箱館居住の要求という問題についてみておこう。安政2年4月3日、アメリカ艦隊の傭船グレタ号が入港した。同船はドイツ船で乗船していた商人リュードルフもドイツ人であったが、同船が入港できたのは、マストにアメリカの国旗を掲げていたからであった。リュードルフの来航目的は、アメリカ艦隊への必要物資の補給と箱館での通商にあった。そのため彼は、入港早々箱館の役人(箱館奉行配下の応接掛他)に、同船に羅紗・衣類・鏡・酒・ガラス器・砂糖・ゲーベル銃・ピストル等の商品を積載していることを告げて箱館での通商を要求したが、役人は、「薪水食料等給し候為之開港ニ付、商売は難相成」として積載品の購入は勿論、物々交換についてもこれを拒否し、上陸と市中遊歩を許可したのみであった(『幕外』10−189)。これを不満としたリュードルフは、箱館奉行に書状で、日米和親条約の第7条に「開かれた港に入港する合衆国の船舶に対し、金銀貨および物品と他の物品の交換を許す」とあることを挙げて、箱館での通商を強く要求した(『グレタ号日本通商記』、箱館奉行宛リュードルフ書状の日本側通詞和訳は、『幕外』10−191)。しかし、これに対する奉行の回答は、「右个條之趣は、全交易之筋ニは無之、金銀銭を以食料其外買求方差支候船は、此方有用之品物を差出候訳故、此度も実ニ金銀銭差支候ハヽ、品物差出候とも、又は不足之分は、右代銭追而差越候而も宜」しいというものであった(『幕外』10−188)。これについてリュードルフは、「第七条に関する日本側のこの解釈は、ずいぶん変わっている。昨日の話と、だいぶ矛盾している」(『グレタ号日本通商記』)と記しているが、条約第7条は交易を規定したものではないとしながらも、他方で本来的な自由貿易とはその性格が異なるとはいえ、実質的には通商に等しい行為を認める旨の回答をしていたのだから、リュードルフが右のように受け取ったのも当然のことであった。
 かくしてリュードルフは、以後″物々交換″という方法を巧みに活用して事実上の交易を行っていったが、奉行側から必要以上の品物を返納するよう命じられたため、やむなく一部返納した。それから6日後の4月23日、リュードルフが待ち受けていたアメリカのフリゲート艦ヴィンセンス号が入港した。同艦にはアメリカ艦隊司令官ロジャーズが乗艦していた。ロジャーズは、後述のアメリカ人商人リード等の箱館居住の件で箱館奉行と交渉しようとしていたが、同艦にはオランダ語のできる人がいなかったため、オランダ語の堪能なリュードルフに英文のオランダ語訳を依頼した。リュードルフは、これ以前にも既にイギリス船やアメリカ船と日本側役人との通訳を積極的に買って出ていたが、ロジャーズに右の件を依頼されて以来、日米和親条約の条文解釈をめぐる日米交渉において、アメリカ側の重要なオランダ語通訳として活躍していくこととなった。そのためもあって、リュードルフは、日米和親条約の各条文の表現が英語版・オランダ語版と日本語版との間にいくつかの点で大きな不一致があることを発見するに至るのである(同前)。特にリュードルフ自身にかかわる第7条について、彼は次のように記している。「アメリカ条約では、第七条がこうなっている。Ships etc. shall be permitted to exchange gold and silver coin and articles of goods against other articles of goods etc.とあって、それ以外に、この条文には何も付加されていない。ところが、日本語で書いた条約には、なお、次の文句が付いている。as many as may be neccesary for them.日本人はこれを楯にとって、こう言う。通商は許されていない。そして、日本へ来る船は、自己の使用に必要であるだけを買うことが許されているにすぎない、と」(同前)。「as many as」以下の文は、和文の「入用の品」を英訳したものであるが、表序−3をみても分かるように、このリュードルフの指摘は的を射たものであった。因に第7条の蘭文和訳は、「合衆国船隻の来舶を准されたる二港内ニ於て、此度日本政府より是か為に設けたる約定の如く、金銀銭貨及品物を以て、各種の品物と兌換(トリカヘ)するを准すへし」(『幕外』5−243)となっており、文意は英文と殆んど異ならなかった。
 箱館奉行がリュードルフに必要以上の品物を返納させたのも、まさにリュードルフが指摘するところの日本語版の特異な表現によるものであり、それだけにリュードルフは、右の事実を知るに至って、日本側のこうした条文解釈とその対応のあり方に改めて大きな疑問と不満を抱かざるをえなかった。そのためロジャーズは、こうしたリュードルフの意を受けて、箱館奉行に対し次のように抗議した。「條約第七个條之内、和文ニは入用品与申儀有之哉ニ候得共、ペルリより相達候書面ニは無之、たとへ入用之品と有之候共、不用之品は不買求、何も入用之品故買入候事ニ而、本国ニ而は交易も相済候儀与相心得居候、然るを、今度商人買入候品多分と申、為差戻候儀、條約ニも振れ、不都合之次第ニ有之、弥右之心得ニ候ハヽ、大統領江可申立」(『幕外』11−75)と。箱館奉行竹内保徳は、このロジャーズの抗議を受けて、「今度猶買入方等之儀強而不申立、只々七个條之趣、此方之心得を得与承糺候様子ニ相見候間、是迄之趣を以挨拶仕候而は、條約之意味齟齬仕候旨ニ付、容易ニ挨拶も仕兼心痛仕候」としたうえで、あえて日露和親条約第5条(日米和親条約の第7条に対応するもの)の蘭文和訳に「望ミの品物を弁するを許す」(日本語版は「入用の品物を弁する事を許す」〔『幕外』8−193〕)とあることを挙げつつ、「往々は何れにも交易之儀強而可申立」として、その対応策を老中阿部正弘に伺っていること(『幕外』11−75)は注目されてよい。というのも、このことは、竹内自身が日本語版の第7条の表現に問題があることを認識するに至っていたことを示すとともに、いずれ欧米列強との通商条約の締結は避けられないものと認識していたことをも示しているからである。

UNITED STATES OF AMERICA AND
TEE EMPIRE OF JAPAN.

Signed at Kanagawa,March 31st,1854 (3rd day of 3rd Month,7th year of
kayai). Ratifications exchanged at Simoda,February 21st,1855(5th day of
1st month,2nd year of Ansei).
 The United States of America and the Empire of Japaan,desiring to establish firm,
lasting,and sincere friendship between the two nations,have resolved to fix,in a manner
clear and positive,by means of a treaty or general convention of peace and amity,the
rules which shall in future be mutually observed in the intercourse of their respective
countries;for which most desirable objeet the President of the United States has
conferred full powers on his Commissioner,Matthew Calbraith Perry,Special Ambassador
of the United States to Japan,and the August Sovereign of Japan has given similar full
powers to his Commissioners,Hayashi,Dai-gaku-no-kami;Ido,Prince of Tsus-Sima
(Tsushima);Izawa,Prince of Mima-Saki(Mimasaka);and Udono,Member of the
Board of Revenue.And the said Commissioners,after having exchanged their said full
powers,and duly considered the premises,have agreed to the following articles:

ARTICLE T.
 There shall be a perfect,permanent,and universal peace and a sincere and cordial ami-
ty between the United States of America on the one part,and the Empire of Japan on the
other part,and between their people respcctively,without exception of persons or places.

ARTICLE U.
 The port of Simoda,in the principality of Idzu,and the port of Hakodade(Hako-
date),in the principality of Matsmai(Matsumae),are granted by the Japanese as ports
for the reception of American ships,where they can be supplied with wood,Water,
provisions,and coal,and other articles their necessities may require,as far as the
Japanese have them.The time for opening the first-named port is immediately on
signing this treaty;the last-named port is to be opened immediately after the same day in
the ensuing Japanese year.
 Note.−A tariff of prices shall be given by the Japanese officers of the things which
they can furnish,paymemt for which shall be made in gold and silver coin.

ARTICLE V.
Whenever ships of the United States are thrown or wrecked on the coast of Japan,the
Japanese vessels will assist them,and carry their crews to Simoda or Hakodade,and
hand them over to their countrymen,appointed to receive therm;whatever articles the
shipwrecked men may have preserved shall likewise be restored,and the expenses
incurred in the rescue and support of Americans and Japanese who may thus be thrown
upon the shores of either nation are not to be refunded.

ARTICLE W.
Those shipwrecked persons and other citizens of the United States shall be free as in
other countries,and not subjected to confinement,but shall be amenable to just laws.

ARTICLE X.
Shipwrecked men and other citizens of the United States,temporarily living at
Simoda and Hakodade,shall not be subject to such restrictions and confinement as the
Dutch and Chinese are at Nagasaki,but shall be free at Simoda to go where they please
within the limits of seven Japanese miles (or ri) from a small island in the harbor of
Simoda,marked on the accompanying chart hereto appended;and shall in like manner
be free to go where they please at Hakodade,within limits to be defined after the visit of
the Uninited States squadron to that place.

ARTICLE Y.
If there be any other sort of goods wanted,or any business which,shall require to be
arranged,there shall be careful deliberation between the parties in order to settle such
matters.

ARTICLE Z.
It is agreed that ships of the United States resorting to the ports open to them shall
be permitted to exchange gold and silver coin and articles of goods for other articles of
goods,under such regulations as shall be temporalily established by the Japanese Govern-
ment for that purpose.It is stipulated,however,that the ships of the United States
shall be permitted to carry away,whatever articles they are unwilling to exchange.

ARTICLE [.
Wood,water,provisions,coal,and goods required,shall only be procured through the
agency of Japanese officers appointed for that purpose,and in no other manner.

ARTICLE \.
It is agreed that if,at any future day,the Government of Japan shall grant to any
other nation or nations privileges and advantages which are not herein granted to the
United States and the citizens thereof,that these same privileges and advantages shall be
granted likewise to the United States and to the citizens thereof,without any consulta-
tion or delay.

ARTICLE ].
Ships of the United States shall be permitted to resort to no othelr ports in Japan
but Simoda and Hakodade,unless in distress or forced by stress of weather.

ARTICLE ]T.
There shall be appointed,by the Government of the United States,Consuls or Agents
to reside in Simoda,at any time after the expiration of eighteen months from the date
of the signing of this treaty;provided that either of the two Governments deem such
arrangement necessary.

ARTICLE ]U.
The present convention having been concluded and duly signed,shall be obligatory
and faithfully observed by the United States of America and Japan,and by the citizens
and subjects of each respective Power;and it is to be ratified and approved by the
President of the United States,by and with the advice and consent of the Senate thereof,
and by the August Sovereign of Japan,and the ratification shall be exchanged within
eighteen months from the date of the signature thereof,or sooner if practicable.
In faith whereof we,the respectivc Plenipotentiaries of the United States of America
and the Empire of Japan aforesaid,have signed and sealed these presents.
Done at Kanagawa,this thirty-first day of March,in the year of our Lord Jesus
Christ one thousand eight hundred and fifty-four,and of Kayei the seventh year,third
month,and third day.
